TERMS & CONDITIONS

By ordering Elaine Wiltshire Photography products & services you agree to the following: 
 

Appointments

Clients are responsible for the following

  • The property is available at the confirmed date/time of the appointment. 

  • The property is uncluttered, clean and ready to be photographed and/or filmed.

  • The photographer will not be at risk, injury, death or inconvenience while photographing or filming property. 

  • ​The photographer will not be at risk of injury to themselves, any other person or animal.  And will not risk damage to any part of the property or contents.

  • If the client is not happy with the service due to the condition of the property, re-shooting is an option - if available. Additional charges may apply.

  • Photos will be formatted for use on MLS within 24 hours. Video Tours (branded and unbranded) will be available within 48 hours of completion - unless otherwise agreed upon.

  • The photographer is photographing/filming the property“as-is”,whatever the condition of the property is upon arrival. Any staging is to be done prior to arrival. ​

 

​​​​Restrictions on Media Alteration, Modification, and AI Utilization
The Client acknowledges and agrees that the Photographer/Videographer retains full, exclusive copyright and intellectual property rights to all delivered media.
No Unauthorized Editing: The Client shall not alter, edit, manipulate, crop, recolour, add filters to, or otherwise modify the delivered media in any manner without the express, prior written consent of the Photographer/Videographer.
Prohibition of Generative AI Tools: The Client is strictly prohibited from uploading, processing, or inputting any delivered media into generative AI tools, platforms, or software. This includes, but is not limited to, using still images to generate AI-animated videos, text-to-video prompt manipulation ("puppeteering").
Permitted Slideshows: The Client is permitted to compile the unaltered delivered still images into traditional, standard video slideshows (e.g., transitions, panning/zooming over static images, or music overlays) solely for the marketing of the subject property.
Derived Works: Except for the permitted slideshows mentioned above, the Client may not create derivative works, digital compilations, or synthetic media from the delivered files for commercial resale or redistribution.

Exceptions: Minor adjustments required strictly for formatting, sizing, or optimization for specific Multiple Listing Service (MLS) or social media platforms are permitted, provided they do not fundamentally alter the aesthetic or accuracy of the image or videos.

Payment

Payment is to be made within 30 days of the invoice date in full, unless other arrangements are agreed upon in writing.

Accounts not paid within 30 days are subject to a 10% monthly late fee.
